Khi nào người đưa hối lộ được coi như 'không có tội'?

Trong nhiều vụ án, tôi chỉ thấy xử lý "quan tham" mà ít thấy phạt người đưa hối lộ, vì sao vậy trong khi có cả điều luật riêng về hành vi này.
